dc.descriptionThis research work focuses specifically on the analysis of the interpretation of human rights in the Mexican and Nayarit jurisdictions due to the entry into force of the constitutional reform of June 10, 2011 and the interference in the matter by the Inter-American Court of Human Rights. The present document consists of 6 chapters The first chapter reviews 10 concerning the most important constitutional articles for the specific case, 1 and 133; The text of the first of these, part of the reform in question and whose text contains the most important part of the amendment as a whole, because it is precisely Article 1 of the Constitution that allows for diffuse conventional control although with the limitations that the Supreme Court of Justice of the Nation points out to the elected. Article 133 is not included in the reform of merit, however, it suffers a modification of great relevance that is presented not in the text, but in the interpretation that our Supreme Court makes of it, which has already been commented supra lines, that is, in the sense of gradually accepting the diffuse control of the Constitution and, in addition, of the American Convention on Human Rights.es_ES
dc.description.abstractEste trabajo de investigación está enfocado específicamente al análisis de la interpretación de los derechos humanos en el ámbito jurisdiccional mexicano y nayarita en razón de la entrada en vigor de la reforma constitucional del 10 de junio de 2011 y de la injerencia que sobre la materia tiene la Corte Interamericana de Derechos Humanos El presente documento consta de 6 capítulos En el primero, se revisa 10 concerniente a los artículos constitucionales de mayor trascendencia para el caso en concreto, siendo el 1° y 133; el texto del primero de ellos, parte de la reforma en mención y cuyo texto encierra la parte más importante de la modificación en conjunto, porque es precisamente el articulo 1 Constitucional el que permite el control convencional difuso aunque con las limitantes que al electo señala la Suprema Corte de Justicia de la Nación. El articulo 133 no está incluido en la reforma de merito, sin embargo, sufre una modificación de gran relevancia que se presenta no en el texto, sino en la interpretación que del mismo realiza nuestro Máximo Tribunal, que ya se ha comentado supra lineas, es decir, en el sentido de aceptar de manera gradual el control difuso de la Constitución y ademas, de la Convención Americana de Derechos Humanos.es_ES
