| Resumen : | El presente trabajo de investigación, consistió en el análisis de las causas motivadoras de la reforma constitucional para incluir el acceso a la justicia colectiva de quienes ostentaran el interés legitimo de los derechos e intereses colectivos, presentando los elementos que permitan establecer, los inminentes impedimentos que ahora enfrenta este innovador instrumento garantista para el logro de los resultados de una eficaz y certera garantía, Igualmente, exponerla forma en que esta nueva reforma constitucional influyo en el Poder Legislativo Federal, respecto a la competencia y jurisdicción que actualmente ejerce el Estado en las materias del derecho social, respecto del Poder Judicial de la Federación, en el ejercicio de la substanciación de procedimientos materialmente jurisdiccionales que también ejerce el Poder Ejecutivo Federal, analizando el fenómeno jurídico respecto a su exclusividad de su instancia federal y limitación también de las materias del derecho a que esta dirigida y la tendencia excesiva a normar la autorización para otorgarles legitimidad procesal, mediante la representación procesal directa de estos grupos de personas de sus aspiraciones de una justicia con un resultado vinculante, expedito, resarcitorio y accesible económicamente de los legitimados, llevando incluso a normar la substanciación de estas acciones procesales al ámbito civil, cuando las materias de su procedencia provienen de actos y omisiones de las autoridades de la administración publica federal y locales que guardan esencialmente elementos procesales del procedimiento contencioso administrativo y su concurrencia, condenando a la ineficacia de la reforma constitucional en su contenido normativo secundario en el sistema jurídico mexicano. |
| Descripción : | The present research work consisted of an analysis of the motivational causes of the constitutional reform to include access to collective justice for those who hold the legitimate interest of collective rights and interests, presenting the elements that make it possible to establish the imminent impediments that this innovative guarantee instrument now faces in order to achieve the results of an effective and certain guarantee, Likewise, to explain how this new constitutional reform influenced the Federal Legislative Power, with respect to the competence and jurisdiction currently exercised by the State in matters of social law, with respect to the Judicial Power of the Federation, in the exercise of the substance of materially jurisdictional procedures also exercised by the Federal Executive Power, analyzing the legal phenomenon with respect to its exclusivity of its federal instance and limitation also of the matters of the right to which it is directed and the excessive tendency to regulate the authorization to grant them procedural legitimacy, by means of the direct procedural representation of these groups of people of their aspirations of a justice with a binding, expeditious, compensatory and accessible economic result of the legitimized ones, Even leading to regulate the substance of these procedural actions to the civil sphere, when the matters of their origin come from acts and omissions of the federal and local public administration authorities that essentially keep procedural elements of the contentious-administrative procedure and its concurrence, condemning to the ineffectiveness of the constitutional reform in its secondary normative content in the Mexican legal system. |
